On December 11, 2020, the 9th lecture of the Luojia Law Lecture Hall was held at Wuhan University Law School. Prof. Xu Guodong, Distinguished Professor of Xiamen University Law School, Executive Director of the China Civil Law Society and Vice President of the China Foreign Legal History Research Association, was invited to give the lecture, which was hosted by Prof. Zhang Shanbin of Wuhan University Law School, with Prof. Chen Benhan and Prof. Ran Keping as guest speakers. Prof. Meng Qinguo and Prof. Zhang Suhua participated in the lecture.
Prof. Xu gave an insightful talk on "Western Civil Law Rejects the Principle of Equality", "Fundamentalist Socialist Civil Law Rejects the Principle of Equality", "The Reform of the Economic System Gives Rise to the Principle of Equality" and "The Establishment of Unique Provisions". He argued that it is the need for political declarations and the misunderstanding of the equality of commodity relations that has led to the flourishing of equality in our civil law. Article 4 of the Civil Code has a much greater political slogan than its normative significance.
In the discussion session, Prof. Chen Benhan commented on the comparative law, understanding of the principle of equality and the relationship between Article 4 and Article 14 of the Civil Code. Prof. Ran Keping reviewed the philosophical discussion on the principle of equality and shared his understanding in the context of civil and constitutional law. During the Q&A session, Prof. Xu Guodong and Prof. Meng Qinguo answered questions on "the capacity of unincorporated organizations and the scope of application of the principle of equality".
In conclusion, Prof. Zhang Shanbin once again expressed his heartfelt gratitude to Prof. Xu for his excellent presentation. The lecture came to an end with a round of applause.
