On November 4, 2019, the 2nd Symposium on China and Rule of Law in Cyberspace was successfully held in the Wuhan University school of law. The symposium was hosted by Wuhan University Network Governance Research Institute and Wuhan University School of Law. Beijing Deheng (Wuhan) law firm, Beijing Huaxia Diantong Technology Co., Ltd. and Beijing Lvdiantong Technology Co., Ltd helped to organize the conference. Officers, experts and scholars from the technology information center of the Supreme People's Procuratorate , the department of law and regulation of the Ministry of foreign affairs, the Hubei cyber information office, Wuhan Municipal cyber information office, the people's University of China, the Chinese Academy of Social Sciences, the University of foreign trade and economic cooperation, Central South University, Xinjiang University, East China University of political science and law, Southwest University of political science and law, Tencent security management department, Ali Research Institute, and Jingdong Law Research Institute gathered to discuss the future development of cyberspace governance in the era of artificial intelligence.
At 9:00 a.m., the forum officially opened. The opening ceremony was presided over by Sun Jin, professor of Wuhan University School of Law and the executive director of Wuhan University Network Governance Institute.
Xia Yikun, the vice director of Academy of Humanity and Social Science of Wuhan University, pointed out that how to establish an open and normative, competitive and orderly governance rule in cyberspace need experts and scholars from different disciplines and fields to study and discuss together. Professor Feng Guo said that the establishment of the network governance research institute was not only to respond to the demand of the society for high-end compound talents, but also to respond to the legal and academic issues related to the network era. Zhong Fuxiong, the deputy director of the technology and information research center of the Supreme People's Procuratorate, said that Wuhan University should find the right research direction, focus on the key issues, and jointly promote the all-round development of science, technology and informatization of the rule of law in China. Wu Haiwen, the counsellor of the department of treaty and law of the Ministry of foreign affairs, pointed out that we should formulate practical and effective laws and regulations in response to the pressing problems in the current network field. Tian Changbing, the deputy secretary of the party group of the Hubei Higher People's court, pointed out that we should make the Internet rule by law. Qi Zhili, the chief engineer of Beijing Huaxia Diantong Technology Co., Ltd., said that Huaxia Diantong was based on the judicial field, helping the country to build an intelligent, efficient and fair judicial environment.
After the opening ceremony, the first unit "new development of international rules of cyberspace and cross-border data flow" officially started. Professor Kubo Mačák, a legal adviser of the International Committee of the Red Cross and an associate professor of the University of Exeter, UK Law School, introduced the development process of cyberspace governance. Zhao Bo, an researcher of the Law School of Tilburg University, took the protection of personal geographic location data as the theme and compared the current situation of relevant legislation protection in the United States and the European Union. Chen Huihui, a legal expert of Tencent security management department, analyzed the conflicts of cross-border data policies in the United States, the European Union and China from the perspective of value balance of national security and industrial development. Ana Beduschi, a senior lecturer at the University of Exeter, UK, talked about GDPR data and privacy protection in the European Union in his video.
In the evaluation, Liu Yang, an assistant professor of Law School of Renmin University of China, thought that how to legislate in China should be considered in the international competition environment. Dr. Wang Zheng pointed out that how to protect data from different values was also a problem that the countries need to explore at present.
After the first unit, Professor Huang Zhixiong and associate professor Kubo Mačák jointly released the International Cyber Law Interactive Toolkit, and carefully introduced the specific operation process of the "international network law toolkit".
Unit 2 "judicial informatization" was presided over by professor Luo Kun. Nearly 20 experts and scholars from Zhengzhou University school of law, Hubei Higher People's court, Beijing Lvdiantong Technology Co., Ltd., Beijing Weike Asia Pacific Information Technology Co., Ltd., East China University of political science and law, Wuhan University Network Governance Institute, National Network Security College of Wuhan University and Wuhan University School of Information Management attended the meeting.
Zhang Jiajun, a professor of Zhengzhou University Law School, gave a speech on "big data and rules of Adjudication". He analyzed the judicial application of big data and the problems of its development. Li Zhihua, the director of the information management department of the Hubei Higher People's court, introduced how the Hubei Higher People's court used judicial informatization in practice. Meng xiankai, the vice president of Beijing legal science and Technology Co., Ltd., told about the construction of judicial information system from the perspective of enterprise practice. Li Jiang, the vice general manager of Beijing Weike Asia Pacific Information Technology Co., Ltd., took "AI helped the practical application of judicial information" as the theme of the speech. Han Xuzhi, a special appointed deputy researcher of East China University of political science and law, raised several thoughtful questions about "smart justice". Zhuang Han, the vice president of Wuhan Jiangxia District People's Court, pointed out that artificial intelligence should be paid attention to in judicial work. Cai Zhenjiang, an associate professor of the Law School of Xinjiang University, talked about the necessity and benefits of artificial intelligence in judicial informatization
In the evaluation, Professor Ji Donghong explained the definition of artificial intelligence and the role of artificial intelligence. Professor Lu Wei said that the combination of artificial intelligence and industry was a trend. He said how to carefully develop the integration between the two was an important issue. Mr. Lu highlighted in the comments that the development of artificial intelligence could not violate the law.
The meeting was concluded by Professor Luo Kun. Professor Luo pointed out that we should take an open and inclusive attitude towards the development of technology, pay attention to strengthening cross professional cooperation, and gradually promote the development of judicial informatization and intelligence. All the participants agreed that there were still many issues that need further exchanges and discussions.
Unit 3 "law governance of platform economy" was presided over by Li Qing, the executive director of China Economic System Reform Research Association.
Professor Hou Dongde, the director of the Artificial Intelligence Research Institute of Southwest University of political science and law, analyzed the evolution, content and characteristics of the US cyber security strategy. Professor Han Wei analyzed the disputes faced by the EU Innovation damage theory, and put forward three innovative ideas of innovation damage theory. Professor Wu taixuan believed that consumers' interests should be given priority in Internet unfair competition cases. Cui Shufeng, the director of the competition policy research center of Ali Research Institute, said that China's Internet enterprises should not be anti-monopoly. Li Li, the executive director of Jingdong Law Research Institute, put forward suggestions on the revision of e-commerce law. Zeng Xiong, the director of meituan supervision and development department, explained the feasibility and problems of data portability in China. Professor Ye Ming thought that the new questions and new viewpoints raised in this unit were very valuable and would trigger new thinking. Professor Li Guohai said that all speakers were very willing to share their views and discuss from many perspectives such as consumers, operators, platforms, intellectual property protection, etc..
The closing ceremony of the forum was presided over by professor Pi Yong, the vice dean of Wuhan University Network Governance Institute.
Professor Feng Guo, the dean of Wuhan University School of Law, summarized the forum. He said that the forum provided us with many new ideas and new views. Accurate analysis of cyberspace governance issues, innovation of ideas, current situation of the system and future improvement were all reflected in this meeting. Finally, President Feng once again expressed his heartfelt thanks to the guests who took the time out of their busy schedule to attend this meeting, and hoped that everyone would continue to care about the development and common progress of Wuhan University Network Governance Institute in the future.
